1. About these terms of service

This is an agreement between You and SecureAppbox AB. This agreement applies to SecureAppbox’s Services, including different clients, updates, plugins and add-on functions that You use while this agreement is in force.


2. Definitions

“SecureAppbox” means SecureAppbox AB (Sweden).

“Secure Mailbox Sweden” is a supplementary firm name of SecureAppbox.

“Service” or “SecureAppbox Service” means the communications and storage services provided by SecureAppbox, including the SecureAppbox Organizer, SecureMailbox, SharedMailbox, SecureMeetings, SecureForms, SecureAppbox API, updates and add-on functions, in accordance with these Terms of Service (ToS).

“We,” “Us” or “Our” mean the SecureAppbox company.

“You” or “Your” mean you as individual or the company or other legal entity for which you are accepting this Agreement, and Affiliates of that company or entity.

“Account” means a SecureAppbox Service account opened by an individual user or corporation/business/organization/group.

3. About SecureAppbox

SecureAppbox helps private individuals, companies and authorities around the world to share and store messages and documents in an encrypted mailbox that is owned and controlled by You.

The Service secures communication with all the people and organizations that You care about and who deal with important information about your life – doctors, lawyers, accountants, banks, and also with authorities, clients, colleagues and friends. The SecureAppbox Service is easy to use, well integrated with Your regular e-mail, and makes sure important information is always encrypted and securely stored.

4. Reservation of Rights in Services

Subject to the limited rights expressly granted hereunder, We reserve all rights, title and interest in and to the SecureAppbox Services, including all related intellectual property rights. No rights are granted to You hereunder other than as expressly set forth herein.

5. Using the Service

In order to use and control your SecureAppbox Service, You need to register with the Service by creating an Account using a valid e-mail address that is either owned by yourself or by Your company/organization.

It is possible to create more than one Account, for example a private account with a personal e-mail address and a different account for your business communications with your employer’s e-mail address.

In using the SecureAppbox Service, You understand that the ownership of all the content within the encrypted service belongs to the owner of the chosen e-mail address.In using the SecureAppbox Service, You will: 1) obey the law, 2) obey any codes of conduct or other notices SecureAppbox provides, 3) promptly notify SecureAppbox if You learn of a security breach related to the Service.

When using the SecureAppbox Service You may not: 1) engage in, facilitate or further unlawful conduct, 2) use the Service in a way that harms SecureAppbox or any customer of the Service; damage, disable, overburden, or impair the Service or interfere with anyone’s use and enjoyment of the Service.

If the law in Your country prohibits You from using the Service because You are under age, intellectual property rights exist or simply because this type of Service is not allowed, do not use the Service. If You obtain anything from a third party through the Service, You understand that your relationship with respect to those things is with the third party directly and not with SecureAppbox. In the event You assert a claim that relates to or implicates your relationship with a third party, You shall therefore only assert such claim against the third party.

As a user of the Service you must make sure your e-mail address exist, works and does not reject notifications repeatedly. Accounts where notifications are repeatedly rejected may be deleted by SecureAppbox.

Accounts that have never been verified after creation will be deleted by SecureAppbox.

6. On content

Subject to the limited rights granted by You hereunder, We acquire no right, title or interest from You or Your licensor(s) under this agreement in or to Your data, including any intellectual property rights therein.

You understand that SecureAppbox does not control or endorse the content that You and others post or provide in the Service. You understand that SecureAppbox may need, and You hereby authorize SecureAppbox to encrypt, use, modify, copy, distribute and display content posted on the Service to the extent necessary to provide the Service. We take no responsibility for the content provided by you on the Service.

This includes: 1) storing and retrieving the content, 2) making the content available to You and to those members to whom You have granted access, 3) conforming to the limitations and terms of the Service.

You understand that sharing content that violates others’ copyrights and other intellectual property rights violates this agreement. Further, SecureAppbox may refuse to make Your content available and may remove Your content from the Service at any time based on requirements in mandatory law.

7. Payment terms and conditions

You agree to pay SecureAppbox any applicable charges and rates as stated on the SecureAppbox website in connection with Your purchase and use of the Service.

To purchase payable Service, you need a sufficient balance on Your SecureAppbox account. Money You deposit in Your account is used toward payment of Your choice of services that vary depending on Your usage. You load Your account through Your debit or credit card, or other means which may be made available by SecureAppbox. SecureAppbox reserves the right to stop accepting debit or credit cards from one or more issuers.

If You do not use the Service for a period of 365 days, any unused credit in Your account will expire. Expired credits are not refundable. You can still access and use the Service, but if You want to use chargeable features You will have to load Your account with new credits.

If Your account was pre-loaded with funds as a registration bonus from SecureAppbox, these funds must be used within 180 days or they will expire.

SecureAppbox may change the rates for the Service including add-on functions (such as, but not limited to, SMS notifications, sending large attachments, sending volume messages, storage space, electronic signatures and external software plugins) at any time by giving a thirty (30) days notice of such change via a SecureAppbox message to Your account as well as on the SecureAppbox website at, https://www.securemailbox.com. If You do not wish to accept such adjustment of rates, You may discontinue Your use of the Service at any time. The new rate will apply to Your next purchase after the adjustments have been published on the SecureAppbox website. If You continue to purchase and/or use the Service following the adjustments of the rates, and our notification of such adjustments, SecureAppbox will regard this as Your acceptance of the new rates.

In the event You believe that SecureAppbox has charged You in error, You must contact SecureAppbox’s customer services at info@securemailbox.com within 90 days after such charge. No refunds will be given for any charges which are more than 90 days old.

SecureAppbox will not refund the balance on Your account in the event You terminate Your user account(s). SecureAppbox will not refund pre-paid monthly subscription fees for a downgraded account or removed business group. Compensation under this agreement will only be made in the form of credit for use of the Service.

SecureAppbox reserves the right to terminate these Terms of Service with immediate effect, automatically and without recourse to the courts, in the event of any abuse by You of these terms relating to refunds.

8. Additional terms for monthly charges

You may choose to upgrade Your account to a level with a monthly fee. The monthly fee is paid in advance and may be paid month to month or for several months at the time. The fee will either be deducted from Your selected debit or credit card or by other means made available to You by SecureAppbox. If the monthly fee is not received from You, SecureAppbox may cancel or inactivate Your account(s), business group(s) or organization(s).

9. Additional terms for business groups

You may choose to create a business group where You are responsible for all Service fees for all members in the group (Consolidated Billing). All service costs consumed by the group members are then charged to Your group “main” account. If payments for these costs are not received from You, SecureAppbox may cancel or inactivate Your account(s) or business group(s).

10. Additional terms for organizations

You may choose to create an organization where You are responsible for all Service fees for all members. Service costs consumed by the members of the organization are then charged to You. If payments for these costs are not received from You, SecureAppbox may cancel or inactivate Your organization(s) and associated account(s).

11. Additional terms for Auto-recharge

You may choose to auto refill Your account balance monthly or when it reaches a critically low level (Auto-recharge feature). The Auto-recharge feature will be enabled when You select the box for that option. Your SecureAppbox balance will be recharged with the same amount and by the same payment method chosen when You first signed up for Auto-recharge, unless You subsequently change the amount by accessing Your Account. For example, if You charge Your account with 5 euro by using Your credit card, and You enable Auto-recharge, the recharge amount charged to Your credit card will also be 5 euro. In the future, the same amount will be charged to Your credit card every time Your Service account balance goes below the threshold set by the Service from time to time. If You do not want to enable Auto-recharge, simply don’t check the box. You can disable Auto-recharge at any time by accessing Your Account.

For some optional features, having Auto-recharge turned on may be mandatory.

12. Integration with other providers

12.1 Integration with Non-SecureAppbox Services, including 3rd party developed clients and services connecting to the SecureAppbox API and other services integrated with the SecureAppbox Services. The Services may contain features designed to interoperate with Non-SecureAppbox Applications (e.g. Salesforce, Scrive, Worksite or IMR Pro). To use such features, You may be required to obtain access to such Non-SecureAppbox Applications from their providers. If the provider of any such Non-SecureAppbox Application ceases to make the Non-SecureAppbox Application available for interoperation with the corresponding Service features on reasonable terms, We may cease providing such Service features without entitling You to any refund, credit, or other compensation.

12.2 Non-SecureAppbox Applications and Your Data. If You install or enable Non-SecureAppbox Applications for use with Services, You acknowledge that We may allow providers of those Non-SecureAppbox Applications to access Your Data as required for the interoperation of such Non-SecureAppbox Applications with the Services. We shall not be responsible for any disclosure, modification or deletion of Your Data resulting from any such access by Non-SecureAppbox Application providers.

12.3 Acquisition of Non-SecureAppbox Products and Services. We or third parties may from time to time make available to You (e.g. a mailApplication or legacy system integration client) third-party products or services, including but not limited to Non-SecureAppbox Applications and implementation, customization and other consulting services. Any acquisition by You of such Non-SecureAppbox products or services, and any exchange of data between You and any Non-SecureAppbox provider, is solely between You and the applicable Non-SecureAppbox provider. We do not warrant or support Non-SecureAppbox products or services, whether or not they are designated by Us as “certified” or otherwise, except as specified in an Order Form. Subject to Section 12.1 (Integration with Non-SecureAppbox Services), no purchase of Non-SecureAppbox products or services is required to use the Services except a supported computing device, operating system, web browser and Internet connection.

13. How long does Your agreement with SecureAppbox last?

The agreement will be effective as of the date of Your acceptance thereof by accepting a message in the Service or links as may be designated by SecureAppbox, or the date of Your first use of any of the Service and add-on functions, whichever occurs earlier, and will remain effective until terminated by either SecureAppbox or You as set out below.

If You do not use the Service for a period of 2 years SecureAppbox may inactivate Your account. You can reactivate the account by contacting SecureAppbox customer service up to 365 days after inactivation.

You and/or SecureAppbox may terminate Your agreement with SecureAppbox at any time.

14. No warranty and limitation of liability

SecureAppbox provides the Service ‘as-is’. SecureAppbox does not guarantee the accuracy or timeliness of information available from the Service. SecureAppbox gives no express warranties, guarantees or conditions. You may have additional consumer rights under Your local laws that this agreement cannot change. SecureAppbox excludes any implied warranties, including those of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.

You can recover from SecureAppbox only direct damages up to an amount equal to Your Service fee paid to SecureAppbox for one month. You cannot recover any other damages, including consequential, lost profits, special, indirect, incidental or punitive damages. Any claim related to this agreement or the Service may not be brought unless brought within one year. The one-year period begins on the date when the claim first could be filed. This applies to You and Your successors. It also applies to SecureAppbox and our successors.

15. Notices

This agreement is in electronic form. There may be additional information regarding the Service that the law requires us to send you. SecureAppbox may send You this information in electronic form. You have the right to withdraw this consent, but if You do, SecureAppbox may cancel Your Service. SecureAppbox may provide required information to You:

  • by a message in the Service to Your account.
  • on the SecureAppbox web site that will be designated in a notice sent to You in the Service at the time the information is available.

Notices provided to You via Service messages will be deemed given and received on the transmission date of the message.

16. Changes in functionality and terms

SecureAppbox may change the Service or delete features at any time and for any reason. SecureAppbox may cancel or suspend Your Service at any time.

If SecureAppbox changes the terms of this agreement, then SecureAppbox will tell You at least 30 days before the change takes effect. If You do not agree to the changes, then You must cancel and stop utilizing the Service before the change takes effect. If You do not stop using the Service, then Your use of the Service will continue under the changed agreement.

Further, SecureAppbox may assign this contract, in whole or in part, at any time with or without notice to You. You may not assign this contract, or any part of it, to any other person. You may not transfer to anyone else, either temporarily or permanently, any rights to use the Service or any part of the Service.

These terms of service may have been translated into Your language. However, this English version of SecureAppbox terms of service governs Your use of the Service and add-on functions should there be any conflict in terms.

17. Governing law and venue

This agreement shall be governed by and interpreted according to Swedish law. Any dispute, controversy or claim arising out of or in connection with this agreement shall be finally settled by Swedish Courts, with Stockholm District Court (Stockholm’s tingsrätt) as court of first instance.
